How Much Compensation Can You Claim from Medical Negligence?

Have you been a victim of medical negligence? Healthcare professionals have a duty of care that they must provide to their patients but when this is neglected it can lead to a wide range of different issues. People put faith in healthcare professionals and more often than not they provide a high level of care, but sometimes there will be mistakes, a poor level of care or harm caused through treatment (or lack of treatment).

Types of Negligence 

There are many different types of medical negligence, such as misdiagnosis, incorrect treatment, surgical errors, birth injuries and care home claims amongst many other types. The consequences of medical negligence can be severe and even lead to fatalities or life-altering injuries. In addition to the physical suffering that someone can endure as the result of medical negligence, it can also have a severe impact on somebody’s wellbeing and also cause economical damages too.

Taking Action

If you have been the victim of medical negligence then it is important that you take action. The health service is generally very good but it is important that those that are responsible are held accountable so that a similar incident does not happen again. What happens to the healthcare professional if a medical negligence claim is successful will depend on the severity of the case. Less serious medical negligence claims are unlikely to have any further action while in severe cases an investigation will be carried out which could lead to a suspension/loss of jobs. 

In all cases, most law firms will seek to get the organisation to review procedures and make sure that steps are taken to stop the incident from happening again. Some people also have concerns that a successful claim would see money taken out of the NHS budget – this is not the case as payouts are made by NHS Resolution – a separate Government organisation which acts in a similar manner to an insurance company.

Compensation

The amount that you are entitled to after a successful medical negligence claim will depend entirely on the damages suffered. Various factors will be considered, including physical pain, suffering, emotional trauma, loss of earnings, loss of future earnings and ongoing care. Compensation can help to build towards a brighter future while also holding the responsible parry accountable and helping the individual to get closure on the incident. 

Nobody expects to be the victim of medical negligence when they seek healthcare but it can happen. Whether this is an accident or a poor level of care, medical negligence can change lives and cause hardship in many areas. This is why it is so important to seek compensation with the help of a specialist law firm who can work on your behalf to get the compensation that you deserve.
